Case No2006/346
Decision No2006/418
SanctionFine
Appealed ByPublic Prosecutor

Summary

In the petition submitted to the court, the respondent lawyer used statements directed at their colleague representing the opposing party that were offensive, exceeded the legal boundaries of defense, and lacked objectivity. The warning penalty issued by the Bar Disciplinary Board was converted into a fine by applying recidivism provisions due to the nature of the act and the lawyer's prior disciplinary penalties. The TBB Disciplinary Board affirmed the decision as amended, confirming that the statements violated the rules of the profession.

The Facts

Disciplinary proceedings were initiated against the respondent lawyer on the allegation of insulting their colleague representing the opposing party in a petition submitted to a civil lawsuit by making accusations such as "talking big" and "opportunist."

Assessment

It was determined that the statements used by the respondent lawyer against their colleague in the court petition fell outside the legal boundaries of the right of defense and offended the colleague. It was stated that the act constituted a violation of Articles 5 and 27/1 of the TBB Rules of the Profession. Since the respondent had prior finalized disciplinary penalties, it was ruled that the recidivism provisions of the Attorneyship Law must be applied, and the warning penalty issued by the board of first instance was insufficient and had to be converted into a fine.

Outcome

It was ruled that a fine be imposed on the respondent lawyer.
