Shock Decision from the Ministry Regarding Non-Producing Fishermen
Official titleRegulation on Amending the Aquaculture Regulation
This is a regulatory amendment that tightens and reorganizes the rules regarding production interruptions, project periods, transfer processes, and capacity utilization rates in aquaculture facilities.
Details of the Regulation
With the regulatory amendment made by the Ministry of Agriculture and Forestry, new administrative sanctions and time limits have been introduced to ensure the continuity of production in aquaculture. The requests of entrepreneurs to suspend production for justified reasons have been limited to a maximum of 1+1 years, while the authority to determine the period in cases of force majeure, such as natural disasters and epidemics, has been left entirely to the Ministry. It has been stipulated that projects will be cancelled if an aquaculture certificate is not obtained within 18 months from the lease agreement. With the new rule introduced regarding the capacity utilization of net cage facilities in seas or dam lakes, the capacities and allocated water areas of facilities producing below 75% of their approved capacity in a 3-year period will be reduced according to their actual production. In addition, it has become mandatory to issue an aquaculture certificate within 60 days for projects whose transfer procedures are completed, and it has been stated that projects failing to comply with this period will be cancelled.

REGAS Commentary
This regulation targets businesses that reserve water areas and keep them idle or operate at low capacity. The luxury for entrepreneurs to occupy water areas without producing is eliminated, and area reduction is carried out based on actual production. Investors need to pay close attention to the 18-month certificate acquisition and 60-day post-transfer registration periods.
