Check Every 3 Months: Unverified Lines are Being Closed

Official titleRegulation on Amending the Regulation on Consumer Rights in the Electronic Communications Sector

A regulation amendment has been published that tightens subscription agreement setup and identity verification processes in the electronic communications sector, updates corporate membership requirements, and mandates the closure of lines for which activity cannot be verified every 3 months.

Details of the Regulation

The Information and Communication Technologies Authority (BTK) has made critical amendments to Article 7 of the Regulation on Consumer Rights in the Electronic Communications Sector. Within the scope of the new regulation, Identity Verification Regulation standards have been made mandatory for subscription agreements to be made in writing or electronically, mandating identity verification via contact electronic identity or near-field communication (NFC) technologies. Biometric data and identity-verifying passwords will be actively used in the process.

For corporate subscriptions, official document and registration number standards that must be submitted have been redefined for every legal entity type, from associations to political parties, and from public institutions to commercial companies. Operators are required to obtain these documents through their originals and exclusively by transferring them to the electronic environment. In addition, it has been stipulated that limitations may be introduced by the BTK regarding the maximum number of lines that natural and legal persons can open.

One of the most critical innovations is the periodic audit mechanism. Operators will check the activity of all their subscribers every three months via KPS (the national Identity Sharing System). The lines of subscribers whose identity or activity cannot be verified in the checks performed will be gradually restricted following notification and completely closed within 90 days. The provisions of the Regulation will enter into force on June 25, 2026.

REGAS Commentary

This regulation is revolutionary in the fight against fake identities and "open lines" opened in the names of others without their knowledge. Although line opening processes have become more secure for citizens, there is a risk of sudden closure of lines belonging to individuals whose records are not up to date in the KPS system. In particular, the identification and closure of lines registered to companies that have lost their legal personality will clean up data pollution in commercial life.

Questions You Might Have

Can a new mobile line be opened with an old-type identity card that lacks electronic verification capability?
No. Except for temporary identity documents and certain foreign national exceptions, a new subscription agreement cannot be established with identity documents lacking identity verification capability.
Will my line be closed immediately if my identity information cannot be verified via KPS?
It will not be closed immediately. You are warned via SMS within 24 hours from the moment it cannot be verified, your line is restricted within 30 days, and if verification is still not made at the end of 90 days, your line is completely closed.
What happens if the KPS activity of the authorized person cannot be verified for lines opened on behalf of companies?
If the legal entity continues to exist, the line is not closed, but no new subscription transactions are allowed to be made over that line until a new authorized person is appointed.
