Automatic Depreciation Payment for Accident-Involved Vehicles
Official titleGeneral Terms Regarding the Amendment to the General Terms of Compulsory Financial Liability Insurance for Motor Vehicles
With the amendment made to the General Terms of Compulsory Traffic Insurance, depreciation determination, use of original/equivalent parts, documents requested for compensation payments, and the rights of the beneficiary have been re-regulated.
Details of the Regulation
The Insurance and Private Pension Regulation and Supervision Agency (SEDDK) has made significant amendments to the General Terms of Compulsory Financial Liability Insurance for Motor Vehicles (Traffic Insurance). According to the new regulation entering into force on July 1, 2026, depreciation applications in material damage accidents have been automated, and those applying for vehicle damage will also be deemed to have applied for a depreciation claim. In parts replacements, the rule is the use of original parts; in order to install equivalent or reusable parts instead of original parts, the approval of the beneficiary or the condition that the original part cannot be procured shall be required, and the burden of proof for this situation shall belong to the insurance company.
Furthermore, in heavily damaged (totaled) vehicles, compensation shall not be paid without stamping the registration certificate with "withdrawn from traffic." In bodily injuries, procedures regarding temporary/permanent caregiver expenses and disability compensation have been detailed, documents to be requested in compensation applications (Annex-6) have been updated, and a mobile phone verification requirement for the beneficiary has been introduced.
Finally, leaving the scene of the accident due to life safety reasons after the accident or for mandatory reasons such as going to a healthcare institution for treatment purposes has been excluded from the grounds for the insurance company to exercise its right of recourse against the insured.
Questions You Might Have
- Can the insurance company directly install aftermarket parts after my car has an accident?
- No, if the part cannot be repaired, the original must be used first. In order to install an equivalent part, either you must give your approval, or it must be proven by the insurance company that the original part cannot be procured.
- Do I need to initiate a separate application process to receive depreciation compensation?
- No, the application you make for vehicle damage automatically covers the depreciation claim as well. The insurance company is obliged to notify you of the amount within the first business day following the arrival of the expert report.
- Can the insurance company exercise right of recourse against the driver who left the scene of the accident due to life safety reasons after the accident?
- No, leaving the scene of the accident due to life safety hazards or mandatory circumstances such as going to a healthcare institution for treatment/assistance purposes is not considered a ground for recourse.

REGAS Commentary
This regulation is quite advantageous for vehicle owners. In particular, insurance companies are prevented from using aftermarket (equivalent) parts without the knowledge of beneficiaries after accidents. From now on, the insurance company will not be able to install aftermarket parts without obtaining your approval or proving that the original part is not available. In addition, the ordeal of making a separate application for depreciation has ended, and the damage application has been accepted directly as a depreciation claim. This situation will reduce bureaucracy and prevent loss of rights.
