REGULATIONS

Limit from TENMAK on Nuclear and Science Awards

Official titleRegulation Amending the Regulation on the Award Program and Event Supports of the Turkish Energy, Nuclear and Mineral Research Agency

With the amendments made to the Regulation on the Award Program and Event Supports of the Turkish Energy, Nuclear and Mineral Research Agency (TENMAK), awarding processes, legal grounds, and certain award conditions have been updated.

Before

There was no upper limit determined by the President for award amounts and number of recipients. There was no provision for awarding the TENMAK (Turkish Energy, Nuclear and Mineral Research Agency) Service Award to the inheritors of deceased scientists. The condition of being 'living' was not specified for the TENMAK Young Researcher Award. It was possible for the TENMAK Special Award to be given to the same person more than once. Article 15 of the Regulation was in entry into force.

After

The legal basis articles of the Regulation were updated. The number of recipients and the award amount per person for TENMAK Science, Service, Young Researcher, and Special Awards are determined by the Executive Board upon the proposal of the President, provided that they do not exceed the upper limits set by the President. Plaques and certificates have been added to these awards, and no ranking is made among the award recipients. For the TENMAK Service Award, the awards of non-living scientists will be given to their legal inheritors. For the TENMAK Young Researcher Award, the condition of being alive was clarified by adding the phrase 'living and not having completed forty years of age'. The condition that the TENMAK Special Award can be given to the same person only once was introduced. Article 15 of the Regulation was repealed.

Details of the Regulation

With the regulations enacted, the legal basis articles of the Regulation on the Award Program and Event Supports of the Turkish Energy, Nuclear and Mineral Research Agency have been updated. Furthermore, while determining the number of recipients and the award amount per person for the TENMAK Science Award, TENMAK Service Award, TENMAK Young Researcher Award, and TENMAK Special Award, the condition of not exceeding the upper limits determined by the President was introduced. It was explicitly stated that a plaque and certificate of merit will be awarded in addition to these awards, and no ranking will be made among the award recipients. In particular, a provision was added for the TENMAK Service Award stating that the awards of deceased scientists may be given to their legal heirs. For the TENMAK Young Researcher Award, following the phrase 'who have not completed forty years of age', the phrase 'living' was added to emphasize the condition that the recipient must be alive. A new restriction was introduced for the TENMAK Special Award, specifying that it may be given to the same person at most once. Finally, Article 15 of the Regulation was repealed.

REGAS Commentary

This regulatory amendment aims to ensure that award programs within TENMAK are conducted more transparently and within specific rules. In particular, introducing upper limits set by the President regarding award amounts and numbers of recipients creates a centralized upper limit oversight in award processes. The 'being alive' and 'one-time award' conditions introduced for young researchers and special award recipients provide clarity regarding the purpose and scope of the awards. The provision allowing the granting of awards to the heirs of deceased scientists is an important regulation for protecting post-mortem rights. Overall, the amendments make award processes more standardized, resolving potential ambiguities regarding entitlement.
