A New Era Begins in Second-Hand Goods

Official titleRegulation on Refurbished Products

This Regulation published by the Ministry of Commerce comprehensively regulates the procedures and principles regarding the offering for sale of used goods as refurbished products. Repealing the previous regulation, this arrangement introduces innovations across a wide spectrum, from the authorization of refurbishment centers to consumer rights.

Before

The Regulation on the Sale of Refurbished Products, published in the Official Gazette numbered 31221 on 22/8/2020, was in force. This regulation had defined the basic framework for the sale of used products after refurbishment.

After

With the Regulation on Refurbished Products, the implementation procedure and principles for offering used goods for sale as refurbished products have been regulated in a more comprehensive and detailed manner. Significant innovations have been introduced, particularly regarding refurbishment authorization certificate conditions (100 Million TL capital), consumer rights (minimum 1-year warranty, 14-day right of withdrawal), YÜBİS integration, and special refurbishment conditions for products with electronic identity information.

Details of the Regulation

The Regulation on Refurbished Products regulates the activities regarding the refurbishment and re-offering for sale of used goods determined by the Ministry. With this Regulation, the Regulation on the Sale of Refurbished Products published in the Official Gazette dated 22/8/2020 and numbered 31221 has been repealed. While strengthening consumer protection, the new regulation aims to increase the transparency and reliability of refurbishment processes.

The Regulation makes it mandatory for refurbishment centers to obtain a refurbishment authorization certificate from the Ministry and requires specific conditions for this certificate, such as being a capital company and having a paid-in capital of not less than one hundred million Turkish liras. Refurbishment processes will be carried out through the Refurbished Product Information System (YÜBİS) created by the Ministry, and it will be mandatory to include the phrase 'refurbished' and information on the refurbishment center on the packaging and label of refurbished products.

In order for used goods with electronic identity information to be refurbished, special conditions have been introduced, such as being included in the White List, having data traffic regarding at least one year prior, and performing a call operation by being activated on the network by the refurbishment center. Consumers' rights, such as the right of withdrawal (14 days) and a refurbished product warranty of at least one year, have been detailed and guaranteed. In addition, the responsibilities of refurbishment centers, on-site refurbishment points, and authorized sellers have been determined. The effective date is 1/8/2026, and there are transitional provisions for existing authorization certificate holders.

REGAS Commentary

This Regulation offers significant assurance to consumers by eliminating the insecurity experienced in the second-hand market, particularly in electronic products. Subjecting refurbishment centers to specific standards and authorization processes will increase the quality and reliability of products sold under the name 'refurbished'. Consumers will now be able to shop more consciously, knowing that the refurbished products they purchase are guaranteed and have gone through specific procedures. For businesses, while this regulation raises barrier to entry into the sector, it will contribute to the growth of the sector in the long run by providing a reliable and transparent market environment. The repeal of the old regulation is an important step taken to keep up with developments in the sector and to set clearer rules.
