COUNCIL OF STATE RULINGS

SCT Shock for Atvs from the Council of State!

Official titleDecision of the Council of State (Danıştay) Board of Tax Lawsuit Chambers (E: 2026/2, K: 2026/9)

The Council of State Board of Tax Lawsuit Chambers has ruled that in determining the customs tariff statistical position (G.T.İ.P.) of ATV-type vehicles sold to final consumers, the tractor (T3) designation on the type approval certificates is not sufficient on its own; and that courts must render decisions by taking into account detailed technical explanatory notes and, if necessary, an examination by a court-appointed expert.

Details of the Regulation

The decision was rendered in order to resolve the conflict of jurisprudence between the tax lawsuit chambers of the İstanbul and Bursa Regional Administrative Courts. At the core of the dispute are the Special Consumption Tax (SCT) assessments with tax loss penalties imposed upon the sale to final consumers, without SCT, of vehicles designated as 'T3-Tractor' in their type approval certificates but possessing the characteristics of an 'ATV' (All Terrain Vehicle) in terms of their technical specifications. Different regional administrative courts have rendered conflicting decisions on this matter; while some chambers upheld the penalty by stating that the vehicles did not satisfy the tractor requirements, others annulled the penalties citing the deficiency of the tax audit report or the taxpayer's legitimate expectation based on official documents as reasoning.

The Council of State Board of Tax Lawsuit Chambers emphasized that pursuant to the 'ex officio investigation principle', courts are obligated to investigate the factual and legal aspects of the dispute of their own motion. The Board ruled that the true nature of the vehicles must be determined not merely by looking at the type approval certificate, but within the framework of the technical criteria (engine power, transmission, braking system, maximum speed, etc.) in the Explanatory Notes to the Customs Tariff Schedule and the Explanatory Notes, and, if necessary, by having an examination conducted by technical court-appointed experts.

Accordingly, it has been rendered mandatory for courts, before directly issuing a decision of annulment or dismissal, to fully and accurately determine the customs tariff statistical position of the vehicles in question and to base their review of the lawfulness of the penalized assessment on this technical determination.

REGAS Commentary

This decision serves as a critical warning for taxpayers engaged in the importation, sale, and trade of ATVs and similar off-road vehicles, as well as for citizens purchasing these vehicles. The approach of 'It says tractor on the type approval certificate, therefore I do not pay SCT' will no longer find direct acceptance before the courts. Consumers and dealers must carefully examine whether the actual technical specifications of the vehicles they purchase or sell meet the tractor criteria in the customs legislation (towing capacity, speed limit, etc.); otherwise, the risk of facing retroactive, severe SCT and tax loss penalties is very high.

Questions You Might Have

I bought an ATV that says 'Tractor' on its type approval certificate; might I still be forced to pay retroactive SCT?
Yes. In excess of what is written in the document, it is examined whether the vehicle de facto meets the technical tractor criteria (towing capacity, speed limit, etc.) in the customs legislation. If it does not, SCT is collected.
Can courts directly consider the allegations of the administration or the taxpayer as true in such lawsuits?
No. Pursuant to the principle of ex officio investigation, courts are obligated to examine customs explanatory notes and, in the event of a technical dispute, definitely render a decision by obtaining an expert report.
