Details of the Regulation
The Composition Costs Advance Schedule prepared by the Ministry of Justice has reorganized the amounts of advance payments that debtors must make when applying for composition and the expense items included therein, in accordance with the Enforcement and Bankruptcy Law No. 2004. The regulation establishes the standards for all financial obligations that may be required during the trial process, such as service, postal, announcement, court-appointed expert, composition commissioner, and bankruptcy expenses.
Under the schedule, the advance payment account includes three times the service cost for the number of creditors, seven announcement fees each in the Turkish Trade Registry Gazette and on the Press Advertisement Agency portal, the fee for 50 registered return mail items, three times the court-appointed expert fee, and the commissioner's fee for five months corresponding to the temporary period (a monthly minimum of 3.380 TL). It also requires 1.690 TL for other transactions and 68.900 TL in bankruptcy expenses for debtors subject to bankruptcy, while allowing the court to grant a discount to debtors not subject to bankruptcy.
It has been stated that unused advance payments will be returned, after the decision becomes final, to the bank account or via PTT, and that in the case of insufficient advance payment, a period for completion will be granted in accordance with the provisions of the Code of Civil Procedure. REGAS Commentary
The upfront court fee and advance payment obligations for debtor companies or individuals planning to enter the composition process have been updated at the case-filing stage. For companies subject to bankruptcy, upfront items such as the fixed bankruptcy expense of 68.900 TL and the commissioner's fee for five months determine the cost of the application, requiring businesses that will apply for composition to make serious liquidity plans before applying.
